A legal disclaimer
Welcome to The Green Geeks Ltd. These terms and conditions outline the agreement between you (the "Client") and us (The Green Geeks Ltd, the "Company") for the supply and installation of a heat pump system. By accepting our quotation, you agree to be bound by these terms. We are proud to be an MCS certified installer (Certification No: NAP-80792), and all our work is carried out in accordance with these standards.
Definitions

"Company," "We," "Us": Refers to The Green Geeks Ltd, registered at The Green Geeks Ltd, 3 Coaley Drive, Milton Keynes, MK177DD, Company Registration No: 16410324.

"Client," "You": The person(s) or entity contracting the Company for services.

"Quotation": The formal document provided by us detailing the scope of work, the system to be installed, and the total price.

"System": The heat pump unit and all associated components, pipework, and controls as specified in the Quotation.

"Site": The property where the installation will take place.
-
"MCS": The Microgeneration Certification Scheme, a standards organisation for renewable energy installers and products in the UK.
What to include in the T&C document
2. Quotation and Contract

Survey and Quotation: Your Quotation is based on a technical survey of the Site. It is a fixed-price offer valid for 30 days from the date of issue. The Quotation details the exact specifications of the System, total costs (including VAT), and an estimated performance analysis.

Acceptance: A legally binding contract is formed once you provide written acceptance of the Quotation (e.g., by email or signed document) and pay the required deposit.

Changes: Any requested changes to the scope of work after the contract is formed may result in a revised quotation and timeline, which must be agreed upon in writing by both parties.
3. Your Obligations
As the Client, you agree to:

Provide safe and unobstructed access to the Site for our engineers and equipment during the agreed working hours.

Ensure that all necessary utilities (electricity, water) are available.

Inform us of any known structural issues, hidden pipework, or cables at the Site before work commences.

Secure any necessary permissions, such as planning permission or consent from a landlord or freeholder, before the installation start date. We can provide guidance, but the ultimate responsibility is yours.
4. Our Obligations
As your MCS certified installer, we will:

Carry out all work with reasonable care and skill, adhering to the latest MCS standards and all relevant building regulations.

Use only qualified and competent engineers for the design and installation of your System.

Supply goods and materials that are of satisfactory quality, fit for purpose, and as described in the Quotation.

Keep the Site tidy and remove all waste materials upon completion of the installation.

Provide you with a comprehensive Handover Pack upon commissioning, including the MCS certificate, warranties, maintenance instructions, and system schematics.

We the Green Geeks, will be responsible for building control notifications and MCS notifications
5. Payment Schedule
Our standard payment terms are as follows:

Deposit: A deposit of [e.g., 25%] of the total contract price is required upon acceptance of the Quotation to secure your installation date and order equipment. Your deposit is protected by our consumer protection scheme.

Interim Payment: An interim payment of [e.g., 50%] is due upon delivery of major components (e.g., heat pump unit, cylinder) to the Site.

Final Balance: The remaining balance is due within 7 days of the successful commissioning and handover of the System.
Late payments may be subject to interest at a rate of [e.g., 4%] above the Bank of England base rate. Title to the goods supplied does not pass to you until full payment has been received.
6. Installation and Commissioning

Timeline: We will provide you with an estimated installation schedule. While we will make every effort to meet these dates, we cannot be held liable for delays caused by circumstances beyond our control (e.g., extreme weather, supply chain issues). We will keep you fully informed of any such delays.

Making Good: We will fill any holes and re-route visible pipework as neatly as possible. However, the Quotation does not include re-decoration, plastering, or re-laying of floor coverings unless explicitly stated.

Commissioning: Upon completion, we will fully commission the System to ensure it is operating correctly and efficiently. We will provide a full demonstration on how to use your new controls.
7. Your Right to Cancel (Cooling-Off Period)
Under the Consumer Contracts Regulations 2013, you have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire 14 days from the day the contract is formed (i.e., when you accept our quotation).

To exercise this right, you must inform us of your decision in a clear statement (e.g., a letter sent by post or an email). You may use the model cancellation form below, but it is not obligatory.

If you requested us to begin work during the cancellation period, you will be required to pay us a reasonable amount for the work completed up to the point you informed us of your cancellation.

8. Warranties and Guarantees

Workmanship Warranty: We provide a comprehensive [e.g., 2]-year warranty on the installation workmanship from the date of commissioning. This covers any defects arising from our installation work.

Manufacturer's Warranty: The System components (heat pump, cylinder, etc.) are covered by the manufacturer's warranty. This is typically between 5-7 years. We will provide you with all relevant warranty documents in your Handover Pack and will manage any claims on your behalf for the first year.

Insurance Backed Guarantee (IBG): As part of our MCS compliance, your installation is covered by an independent Insurance Backed Guarantee, protecting you in the unlikely event that we cease trading.
9. Complaints and Dispute Resolution
We are committed to providing excellent service. However, should you have any complaints, please contact us immediately so we can resolve the issue. Our formal complaints procedure is as follows:

We will acknowledge your complaint within 48 hours and aim to resolve it within 14 days.

If you are not satisfied with our final response, you can refer your complaint to our independent dispute resolution provider, RECC, as required by the MCS scheme.
10. Liability
Our liability is limited to the total value of the contract. We are not liable for any loss of profit, indirect loss, or consequential loss. This does not affect our liability for death or personal injury caused by our negligence, nor does it affect your statutory rights as a consumer.
11. Data Protection
We will use the personal information you provide to us to supply the services, process your payment, and register your installation with MCS and relevant warranty/guarantee providers. We will process your data in accordance with UK data protection law (UK GDPR).

We use a third party service called Shrunk Punk on our website. This service is provided by Midsummer Energy Ltd. Midsummer Energy Ltd will collect your personal data for the purpose of providing an estimated cost to install a heat pump system at your residential property, and if requested by you, your data will be passed on to third-party companies like ourselves so we can contact you with more information. The Green Geeks is collecting your personal data on behalf of the relevant DNO, for the purpose of submitting your application for installation of low carbon technology at your residential property. We recommend you review the relevant DNO's privacy notice, available on your DNO's website to understand how the relevant DNO, processes your personal data.
12. Governing Law
This contract is governed by the laws of England and Wales, and both parties agree to the exclusive jurisdiction of the courts of England and Wales.
